Terms of Use

These Terms of Service (hereinafter, the "Terms") set forth the conditions for using the services provided by Fuchu Strawberry Picking Farm (hereinafter, the "Farm") on this website (hereinafter, the "Service"). All persons who use the Service (hereinafter, the "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

1. These Terms shall apply to all relationships relating to the use of the Service between the User and the Farm.
2. In addition to these Terms, the Farm may establish various rules and other provisions regarding the use of the Service (hereinafter, the "Individual Provisions"). Regardless of their name, such Individual Provisions shall constitute part of these Terms.
3. If any provision of these Terms conflicts with any provision of the Individual Provisions referred to in the preceding paragraph, the provision of the Individual Provisions shall prevail unless otherwise specified therein.

Article 2 (Fees and Payment)

1. ユーザーは，本サービスの有料部分の対価として，当園が別途定め，本ウェブサイトに表示する利用料金を，当園が指定する方法により支払うものとします。
2. ユーザーが利用料金の支払を遅滞した場合には，ユーザーは年14．6％の割合による遅延損害金を支払うものとします。

Article 3 (Cancellations and Refunds)

1. Cancellations and refunds for reservations made through the Service shall be governed by the cancellation policy set forth in each reservation plan and the disclosures required under the Act on Specified Commercial Transactions.
2. The handling of business suspensions caused by weather or other reasons not attributable to the Farm shall be determined separately by the Farm.

Article 4 (Prohibited Acts)

When using the Service, Users must not engage in any of the following acts:

1. Acts that violate laws or public order and morals
2. Acts related to criminal activity
3. Acts that infringe copyrights, trademark rights, or other intellectual property rights contained in the Service, including its content
4. Acts that destroy or interfere with the functions of servers or networks of the Farm or third parties
5. Acts that commercially use information obtained through the Service
6. Acts that may interfere with the operation of the Farm's services
7. Unauthorized access or attempts to do so
8. Acts of improperly collecting or storing personal information, etc. of third parties
9. Acts of using the Service for improper purposes
10. Acts that cause disadvantage, damage, or discomfort to other users or third parties
11. Acts of making reservations or inquiries using false information
12. Advertising, promotion, solicitation, or commercial activities on the Service not authorized by the Farm
13. Acts of directly or indirectly providing benefits to antisocial forces in connection with the Farm's services
14. Any other acts that the Farm deems inappropriate

Article 5 (Suspension of the Service)

1. If the Farm determines that any of the following circumstances applies, the Farm may suspend or interrupt all or part of the Service without prior notice to Users:
   1. When inspecting, maintaining, or updating the computer systems related to the Service
   2. When providing the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
   3. When computers or communication lines are halted due to an accident
   4. When the Farm otherwise determines that providing the Service is difficult
2. The Farm shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service.

Article 6 (Disclaimer of Warranties and Limitation of Liability)

1. The Farm makes no express or implied warranty that the Service is free from factual or legal defects (including defects relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors or bugs, and infringement of rights).
2. The Farm shall not be liable for any damage incurred by Users arising from the Service. However, this disclaimer shall not apply when the contract between the Farm and the User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act.
3. Even in the case set forth in the proviso of the preceding paragraph, the Farm shall not be liable for damages arising from special circumstances among damages incurred by the User due to default or tort caused by the Farm's negligence (excluding gross negligence), including cases where the Farm or the User foresaw or could have foreseen the occurrence of such damages. In addition, compensation for damages incurred by the User due to default or tort caused by the Farm's negligence (excluding gross negligence) shall be limited to the amount of the usage fee actually received by the Farm for the reservation related to such damage.
4. The Farm shall not be liable for any transactions, communications, or disputes arising between a User and a third party in connection with the Service.

Article 7 (Disclaimer Regarding Content)

1. Content such as fortunes, personality tests, and recommendation information provided on this website (hereinafter, the "Entertainment Content") is provided for entertainment purposes and does not constitute professional advice, instruction, or recommendation.
2. The Farm shall not be liable for any judgments or actions taken by Users based on the Entertainment Content.

Article 8 (Display of Advertisements)

1. The Farm may display advertisements of the Farm or third parties (including affiliate advertisements) on this website. Users agree that the Service may contain advertisements.
2. With respect to third-party advertisements posted on this website, the Farm makes no warranty whatsoever regarding the content, quality, accuracy, legality, etc. of the products or services provided by the advertisers, and shall not be liable for any damage incurred by Users arising therefrom.
3. If a User uses a third party's service through an advertisement, the contractual relationship shall be established directly between the User and the relevant third party, and the Farm shall not be a party to that contract.

Article 9 (Changes to the Service)

The Farm may change the content of the Service or discontinue providing the Service without notifying Users, and shall not be liable for any damage incurred by Users as a result.

Article 10 (Changes to the Terms)

1. If the Farm determines it necessary, the Farm may change these Terms.
2. When changing these Terms, the Farm shall inform Users of the contents of the revised Terms and the effective date by posting them on this website or by another appropriate method before the effective date.
3. If a User uses the Service on or after the effective date set forth in the preceding paragraph, the User shall be deemed to have agreed to the revised Terms.

Article 11 (Handling of Personal Information)

The Farm shall appropriately handle personal information obtained through the use of the Service in accordance with the Farm's Privacy Policy.

Article 12 (Cookies and Access Analytics)

1. The Farm uses cookies and similar technologies on this website to improve the Service and analyze access conditions.
2. The Farm may collect and analyze the usage status of Users by using Google Analytics and other access analytics tools. For details regarding data collection by these tools, please refer to the Farm's Privacy Policy.
3. Users may refuse to accept cookies through their browser settings; however, in such case, some functions of the Service may be restricted.

Article 13 (Notices or Communications)

Notices or communications between the User and the Farm shall be made by the method prescribed by the Farm. The Farm shall deem the contact information provided by the User at the time of reservation or inquiry to be valid, send notices or communications to such contact information, and deem them to have reached the User at the time of dispatch.

Article 14 (Prohibition on Transfer of Rights and Obligations)

Users may not assign to a third party, or provide as security, their status under a reservation or any rights or obligations under these Terms without the Farm's prior written consent.

Article 15 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of any dispute relating to the Service, the court having jurisdiction over the location of the Farm's principal office shall have exclusive agreed jurisdiction.
