These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for use of the services (hereinafter referred to as "the Service") provided on this website by Fuchu Strawberry Picking Farm (hereinafter referred to as "the Farm"). Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

1. These Terms apply to all relationships between Users and the Farm regarding use of the Service.
2. In relation to the Service, the Farm may establish various rules and provisions for use in addition to these Terms (hereinafter referred to as "Individual Provisions"). Regardless of their title, such Individual Provisions shall constitute part of these Terms.
3. If provisions of these Terms conflict with provisions of the Individual Provisions in the preceding article, the provisions of the Individual Provisions shall prevail unless otherwise specifically stated therein.

Article 2 (Fees and Payment Method)

1. Users shall pay the usage fees displayed on this website and separately determined by the Farm, by the method designated by the Farm, as consideration for paid portions of the Service.
2. If a User delays payment of usage fees, the User shall pay default interest at an annual rate of 14.6%.

Article 3 (Prohibited Matters)

Users must not engage in the following acts when using the Service.

1. Acts that violate laws, regulations, or public order and morals
2. Acts related to criminal activity
3. Acts that infringe copyrights, trademarks, or other intellectual property rights included in the Service
4. Acts that destroy or interfere with the functions of the Farm's server or network, those of other Users, or those of third parties
5. Acts that commercially exploit information obtained through the Service
6. Acts that may interfere with operation of the Farm's services
7. Unauthorized access or attempts to do so
8. Acts of collecting or accumulating personal information of other Users
9. Acts of using the Service for wrongful purposes
10. Acts that cause disadvantage, damage, or discomfort to other Users or third parties
11. Impersonation of other Users
12. Advertising, promotion, solicitation, or business activities on the Service not authorized by the Farm
13. Acts intended to meet unknown members of the opposite sex
14. Acts that directly or indirectly provide benefits to antisocial forces in connection with the Farm's services
15. Any other acts that the Farm deems inappropriate

Article 4 (Suspension of Provision of the Service, etc.)

1. The Farm may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following applies.
   1. When performing maintenance, inspection, or updates of computer systems related to the Service
   2. When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
   3. When computers or communication lines, etc. stop due to accidents
   4. When the Farm otherwise determines that provision of the Service is difficult
2. The Farm shall not be liable for any disadvantage or damage incurred by Users or third parties due to suspension or interruption of the Service.

Article 5 (Disclaimer of Warranties and Limitation of Liability)

1. The Farm does not expressly or implicitly warrant that the Service is free from defects, whether factual or legal (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights).
2. The Farm shall not be liable for any damages incurred by Users arising from the Service. However, if the contract between the Farm and the User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act, this disclaimer shall not apply.
3. Even in the case stated in the proviso of the preceding paragraph, the Farm shall not be liable for damages arising from special circumstances among damages incurred by Users due to default or tort caused by the Farm's negligence (excluding gross negligence), including cases where the Farm or User foresaw or could have foreseen such damages. In addition, compensation for damages incurred by Users due to default or tort caused by the Farm's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month in which such damages occurred.
4. The Farm assumes no responsibility for transactions, communications, or disputes, etc. arising between Users and other Users or third parties in relation to the Service.

Article 6 (Changes to Service Content, etc.)

The Farm may change the content of the Service or discontinue provision of the Service without notifying Users, and shall not be liable for any damages incurred by Users as a result.

Article 7 (Changes to the Terms of Use)

The Farm may change these Terms at any time without notifying Users when it determines it is necessary. If a User starts using the Service after changes to these Terms, that User is deemed to have agreed to the revised Terms.

Article 8 (Handling of Personal Information)

The Farm shall appropriately handle personal information obtained through use of the Service in accordance with the Farm's "Privacy Policy".

Article 9 (Notices or Communications)

Notices or communications between Users and the Farm shall be made by methods prescribed by the Farm. The Farm shall deem registered contact information from Users to be valid and send notices or communications to such contact information, and such notices or communications shall be deemed to have reached the User at the time of transmission.

Article 10 (Prohibition of Assignment of Rights and Obligations)

Users may not assign or pledge their status under the service agreement or rights or obligations under these Terms to any third party without prior written consent of the Farm.

Article 11 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of any dispute relating to the Service, the court having jurisdiction over the location of the Farm's head office shall have exclusive agreed jurisdiction.
